regarding the protection of personal data (“GDPR”)
Pursuant to and for the purposes of Article 13 of the European Regulation 2016/679 on the protection of personal data (“GDPR”) and national privacy legislation, we inform you that your personal data will be processed using electronic tools, manual methods, and social networks, both in Italy and abroad.
This privacy notice, drafted based on the principle of transparency and including all elements required by the GDPR, is divided into individual sections, each addressing a specific topic to make reading quicker, easier, and more understandable (hereinafter the “Notice”).
WHO IS THE DATA CONTROLLER?
The Data Controller (hereinafter “Controller”) is BMB s.r.l., headquartered at Via Del Lavoro, 48 – 36034 Molina Di Malo (VI), Italy.

WHAT IS THE LEGAL BASIS FOR PROCESSING?
The legal basis for the processing of your personal data is:
- Contractual obligations;
- Legal obligations;
- Commercial consent and service use consent
FOR WHAT PURPOSES WILL YOUR DATA BE PROCESSED?
a) Your personal data will be processed for the purpose of service management and compliance with legal obligations:
- Execution of the supply contract or supply order.
- Invoicing of amounts due and any additional services.
- Compliance with regulatory obligations, including accounting, administrative, and tax requirements.
- Management of any complaints and disputes.
- Fraud prevention and management of delays or missed payments.
- Protection and possible recovery of credit, directly or through third parties (agencies/credit collection companies, law firms) to whom the necessary data will be disclosed for such purposes.
- Assignment of credit to authorized companies.
- Retention and use of accounting data related to payment punctuality for reward policies and to refuse future contractual relationships.
- Reporting and quality control.
- Technical Communications: Communication and/or sending (via email, SMS, notifications, mail, telephone contact, etc.) of technical information and materials related to the management of the contract and the ongoing service.
b) Furthermore, with your optional consent, your personal data will be processed for the following purposes:
Commercial Communications: communication and/or sending (via email, SMS, mail, notifications, telephone contact, etc.), including automated methods, of information and commercial offers, advertising and promotional materials related to our own services and/or those of third parties.
Event Communications: communication and/or sending (via email, SMS, mail, notifications, telephone contact, etc.), including automated methods, of materials related to events, seminars, and conferences organized directly by us or by third-party companies.
The provision of your data is necessary for achieving the purposes indicated in point a).
Your failure to provide, partial provision, or inaccurate provision of data may result in the impossibility to activate and provide the requested service or to fulfill the supply contract.
Furthermore, the provision of your data for the specific purposes indicated in point b) is optional; however, refusal to provide such data will prevent BMB srl from processing your request and contacting you.
In any case, and as further specified below, you may revoke your consent, even partially, for example by consenting only to event communications and not commercial ones.
TO WHICH PARTIES MAY YOUR PERSONAL DATA BE DISCLOSED?
Your personal data will be processed exclusively by authorized personnel and by individuals appointed as Data Processors in compliance with the GDPR, in order to properly carry out all processing activities necessary to achieve the purposes set forth in this Notice. Your personal data may be disclosed to Public Authorities or Judicial Authorities when required by law or to prevent or suppress the commission of a crime, and in any case to:
- those who are legitimate recipients of communications required by laws or regulations (such as Public Offices and Authorities);
- those who receive communications necessary for the fulfillment of obligations arising from the Service and the signed contract;
- third-party companies specialized in the management of commercial and credit information (such as call centers, data processing centers, banks, etc.);
- companies and/or collaborators for the management of administrative services used to fulfill legal or contractual obligations;
- other parties (companies, corporations, individuals) who collaborate with the Data Controller within the scope of the services and supplies offered.
MINORS
The processing of personal data of minors under the age of 16 is not permitted unless authorized by the holder of parental responsibility.
LEGITIMATE INTEREST OF THE CONTROLLER
The Controller has a legitimate interest in transferring personal data to companies within the corporate group for administrative, analytical, and internal reporting purposes.
HOW LONG WILL YOUR PERSONAL DATA BE PROCESSED?
Your personal data will be retained for the period necessary to achieve the purposes referred to in point a) above. Specifically, your personal data will be processed for a minimum necessary period, that is, until the termination of the contractual relationship between you and the Data Controller, except for any additional retention period that may be required by law.

Data related to the unsolicited submission of curricula will be retained for no more than two years from the date of receipt. Your data will be retained for a longer period in relation to the purposes of disputes and potential legal proceedings.
HOW CAN YOU WITHDRAW YOUR GIVEN CONSENT?
You have the right to withdraw your consent given to the Controller at any time, in whole or in part, without affecting the lawfulness of the processing based on the consent given before the withdrawal. To withdraw your consent, you may contact the Controller at the addresses provided in this Notice.
WHERE WILL YOUR DATA BE PROCESSED?
Your Personal Data will be processed by the Controller within the territory of the European Union. Should it be necessary, for technical and/or operational reasons, to use entities located outside the European Union, please be informed that such entities will be appointed as Data Processors pursuant to and for the purposes of Article 28 of the GDPR, and the transfer of your Personal Data to such entities, limited to the performance of specific processing activities, will be governed by a specific appointment contract in accordance with the guarantees and protections provided by the GDPR.
All necessary precautions will be taken to ensure the full protection of your Personal Data, basing such transfer on the assessment of appropriate safeguards, including, by way of example, adequacy decisions of the third-country recipients issued by the European Commission; adequate safeguards provided by the third-party recipient pursuant to Article 46 of the GDPR.
In any case, you may request further details from the Data Controller if your Personal Data have been processed outside the European Union, requesting evidence of the specific safeguards adopted.
WHAT ARE YOUR RIGHTS?
Please note that you may exercise your rights under the GDPR and, in particular, obtain:
- confirmation of whether or not personal data concerning you is being processed and access to the data and the following information (purpose of processing, categories of personal data, recipients and/or categories of recipients to whom the data have been or will be disclosed, retention period);
- rectification of inaccurate personal data concerning you and/or completion of incomplete personal data, including by means of an additional statement;
- deletion of personal data, in cases provided for by the GDPR;
- restriction of processing in the cases provided for by the applicable Privacy Regulation;
- the portability of the personal data concerning you, if feasible and relevant to the service provided;
- the right to object at any time to the processing of your personal data for reasons related to your particular situation, in full compliance with the applicable Privacy Regulation.

In any case, you always have the right to lodge a complaint with the competent supervisory authority (Data Protection Authority), pursuant to Article 77 of the GDPR, if you believe that the processing of your data violates applicable Privacy Regulations.
